Terms of service.
Terms for using the TechEsthete website and how our client services, deliverables, confidentiality and liability work.
Last updated: 20 October 2026
These terms cover two things: your use of the TechEsthete website, and the general ground rules for how our client services work. Here's the short version. Use the site lawfully and don't misuse it. What we publish here is general information, not advice or a binding offer. Client work is always governed by a signed agreement, and if that agreement differs from these terms, the agreement wins.
Accepting these terms
By using https://www.techesthete.com (the "site"), you agree to these terms. If you're using the site on behalf of a company, you confirm that you're allowed to accept these terms for it. If you don't agree, please don't use the site.
Our Privacy Policy and Cookie Policy explain how we handle personal information and browser storage. They form part of these terms.
Who we are
TechEsthete is an engineering firm, founded in 2013, that works on advertising data. We build data pipelines from ad platforms, data warehouses in our clients' own cloud accounts, dashboards, AI insights and AI agents that act within rules our clients approve.
The site is operated by Techesthete FZE, Business Centre, Sharjah Publishing City Free Zone, Sharjah, UAE. In these terms, "TechEsthete", "we", "us" and "our" mean Techesthete FZE. For client work, it means the TechEsthete entity named in your agreement. "You" means you as a visitor and, where relevant, the organization you represent.
Using the site
You may use the site to learn about TechEsthete, read our content and get in touch. When you use it, you agree not to:
- Break any law, or infringe anyone else's rights
- Scrape, crawl, copy or harvest content or data from the site in bulk, including to build a competing product, dataset or service, or to train AI models for that purpose
- Test, probe or scan the site for vulnerabilities, or try to get around any security measure, without our prior written permission
- Interfere with the site's operation, for example by overloading it or introducing malware
- Try to get unauthorized access to the site, our systems or any account
- Submit false information, impersonate anyone, or use our forms to send spam
- Use the site in a way that harms TechEsthete, our clients or other users
Search engines may index the site in the normal way. If you've found a security issue, please tell us at hello@techesthete.com and don't test further without written permission.
We may suspend or block access to the site for anyone who breaks these terms.
Site content and intellectual property
TechEsthete owns, or is licensed to use, the content on the site, including the text, design, graphics, guides, case studies and our name and logo. You may view the site and share links to it. You may print or save pages for your own reference. You may not copy, republish, sell or otherwise use our content commercially without our prior written permission.
Client names, logos and trademarks shown on the site belong to their owners. We use them to describe our work and the platforms we work with, and they don't give you any rights to use them.
Information only
We publish content to be useful, but it's general information.
- Guides, blog posts and other content are not professional advice (legal, financial, tax, accounting or technical) for your specific situation. Get proper advice before acting on them.
- Pricing. Any price range we share before a signed agreement is an estimate, not an offer. Actual pricing depends on scope and is set only in a signed agreement.
- Case studies and results describe what happened for specific clients, with their data, platforms and circumstances. They don't promise that you'll get the same results.
We work to keep the site accurate and up to date, but we don't guarantee that everything on it is complete, current or suited to your needs.
Forms and communications
Filling in a form on the site, including the contact form and the "ad data plan" form, or emailing or talking with us, doesn't create a contract or oblige either of us to work together. Any plan, estimate or recommendation we share before an agreement is signed is for discussion only.
We handle the information you send us as described in our Privacy Policy.
Client services
All client work is governed by a written agreement signed by both parties, such as a master services agreement, statement of work or order form (your "agreement"). We offer fixed-scope builds, monthly run plans and engineering pods. Pods have a three-month minimum term and then continue month to month. Your agreement sets out the scope, fees, timelines, responsibilities and other terms that apply.
If your agreement conflicts with these terms, your agreement prevails. The client service sections of these terms describe how we generally work. They don't replace or add obligations to a signed agreement unless that agreement says so.
Deliverables and intellectual property
We build in your environment. Code, documentation and runbooks we create for you live in your own code repository and cloud account.
Ownership of deliverables and other intellectual property terms are set in your agreement. Unless your agreement says otherwise, you own the deliverables you pay for once they have been paid in full. We keep ownership of our pre-existing tools, know-how and general methods. Where any of those are built into your deliverables, your agreement will say how you may use them.
Confidentiality
We sign a non-disclosure agreement (NDA) before discovery, and a data processing agreement (DPA) before we get access to any data. We treat your business information and data as confidential under those agreements. How we handle personal data in your systems is explained in "Data we process for clients" in our Privacy Policy.
Please don't send confidential information through the site's forms before an NDA is in place.
Third-party platforms
Our work connects to platforms run by other companies, including Amazon Ads, Amazon Selling Partner API, Amazon Marketing Cloud, Walmart Connect, Shopify, Google, Meta, TikTok, attribution tools, cloud providers and data warehouses. These platforms are third parties. They control their own services, APIs, data access, pricing and terms, and they can change or withdraw them at any time. Changes like these may affect what we can build or deliver. Your use of each platform is subject to that platform's own terms, and you are responsible for keeping your accounts with them in good standing.
TechEsthete is independent. We are not affiliated with, sponsored by or endorsed by Amazon, Walmart, Shopify, Google, Meta or TikTok. Their names and trademarks are used only to describe the platforms we work with, and they belong to their owners.
AI features
Some of our solutions include AI-generated insights and AI agents.
- AI agents act only within rules that the client approves, including spending caps, approval steps and the actions they're allowed to take.
- Write access for AI agents is opt-in. Agent actions are logged and can be rolled back.
- AI outputs are reviewed under the client's rules. AI can make mistakes, so its outputs should be treated as decision support, not guarantees.
- The client is responsible for approving and maintaining the rules, caps and approvals its agents run under, and for decisions made under those rules.
Your agreement sets out the specific responsibilities for any AI features in your engagement.
Links to other sites
The site may link to websites and services run by others. We don't control them and aren't responsible for their content, policies or practices. Their own terms and privacy policies apply when you visit them.
Disclaimers
The site and its content are provided "as is" and "as available." To the extent the law allows, we disclaim all warranties about the site, whether express or implied. That includes warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that the site will always be available, uninterrupted or free of errors or harmful components.
This section is about the website. Any warranties for client services are set in your agreement.
Limitation of liability
To the extent the law allows, neither TechEsthete nor you will be liable to the other for any indirect, incidental, special or consequential loss arising from use of the site. That includes loss of profits, revenue, data or goodwill.
To the extent the law allows, our total liability to you for any claim arising from your use of the site is limited to 100 US dollars. The site is free to use, and this limit reflects that.
These limits don't apply to liability that can't be limited or excluded by law, such as liability for fraud or for death or personal injury caused by negligence. Liability for client services is governed by your agreement, not this section.
Indemnity
If you misuse the site or break these terms, and that leads to a claim against TechEsthete by someone else, you agree to cover our reasonable losses and costs from that claim, including reasonable legal fees. This applies to the extent the law allows. It doesn't apply to any part of a claim that we caused.
Governing law and disputes
For client services, the laws named in your signed agreement apply, along with the dispute process it sets out.
For use of the site without a signed agreement, these terms are governed by the laws of the Emirate of Sharjah and the federal laws of the UAE as applicable, and the courts of Sharjah will have jurisdiction.
Nothing in these terms removes rights you have under the law where you live, including consumer protection rights that can't be waived by contract.
General
If any part of these terms is found to be unenforceable, the rest stays in effect. If we don't enforce a right straight away, we haven't given it up. You may not transfer your rights under these terms without our consent. We may transfer ours as part of a reorganization, merger or sale of our business.
Changes to these terms
We may update these terms from time to time. We'll post the new version on this page and change the "Last updated" date at the top. Changes apply from the date they're posted. If you keep using the site after that, you accept the updated terms. Changes to these terms don't alter a signed agreement.
